These Terms of Use describe the conditions for using the Acoustic Text app and its introductory website, provided by Across Realities. Please read them before using the service. Privacy and information handling are explained separately in our Privacy Policy.

1. Provider and agreement

Across Realities provides Acoustic Text. You can contact us at admin@across-realities.com or visit https://across-realities.com. These terms apply to the app and website, including updates that refer to them.

Use the service only if you can lawfully agree to these terms. If local law requires parental or guardian permission, obtain it before use. If you use the service for an organization, you must have authority to do so. If you do not agree, do not use the service. Nothing here replaces an acceptance or notice procedure required by applicable law.

2. Permission to use the software

Subject to these terms, Across Realities grants you a limited, non-exclusive right to install and use the app on devices you own or are authorized to use, and to access the website for its intended purpose. This is permission to use the software, not a transfer of ownership.

The app, website, branding, artwork and other materials belong to Across Realities or their respective licensors. Do not redistribute, sell or misrepresent them as your own without authorization. Open-source components remain governed by their applicable licenses. Nothing here restricts uses, interoperability work or other activities that applicable law or an applicable open-source license permits.

3. How acoustic messaging works

The app converts text into sound played through the selected audio output. Compatible nearby devices can decode the sound using a microphone and an appropriate reception configuration. Acoustic message transport does not require an internet connection. Advertising, external links and independent device services may still use internet access.

You are responsible for selecting a suitable channel and output device, enabling reception and microphone permission where needed, and coordinating use with nearby participants. Devices may differ in the frequencies they can reproduce or detect. The app is not a telephone service and does not provide a private, addressed messaging connection.

4. Public messages and your content

A broadcast is not limited to your intended recipient. Anyone within acoustic range with a compatible receiver may read, retain or share the text and displayed sender information. Channel selection does not authenticate a person, prevent interception or create a confidential group. Display names and sender identifiers are not proof of identity.

You remain responsible for the content you broadcast and for having the necessary rights and permissions to share it. Do not broadcast confidential information or another person's private information without a lawful basis. You retain your rights in your messages; these terms do not grant us ownership of your conversations or a general right to publish them.

Across Realities does not operate a server archive of acoustic conversations, moderate every local broadcast or control recipient devices. We cannot recall sound already played or remotely remove copies received by others. Refer to the Privacy Policy for local storage and deletion details.

5. Sound playback and consideration for others

Transmission can produce loud or audible sound. Lower-numbered channels use lower frequencies that people nearby may hear as noise; higher frequencies are not necessarily inaudible to everyone. A larger volume may help reception but also increases sound exposure and does not guarantee delivery.

Before broadcasting, check the selected output and volume, consider people and animals nearby, and avoid repeated or prolonged playback that causes disturbance or discomfort. Be particularly careful with headphones, external speakers and amplified playback. Stop playback if it causes discomfort, and follow venue rules and lawful instructions.

You are responsible for how, where and at what volume you initiate broadcasts. Across Realities does not promise that playback will be silent, unobtrusive or suitable for every listener or environment. Responsibility for harm is subject to the specific limits and protected rights in section 10, rather than an unlimited waiver of liability.

6. Reception limits and unsuitable uses

Delivery, accuracy, timing and distance are not guaranteed. Low or unsuitable speaker output, microphone characteristics, device orientation, blocked sound paths, distance, background noise, announcements, reverberation, simultaneous transmissions and operating-system interruptions can cause errors, delays or total failure. An indoor setting or an airplane cabin does not guarantee successful reception.

A completed broadcast means the sending device finished playback; it does not prove that another device received or understood the message. Confirm important information through another appropriate means. Do not use Acoustic Text as your sole means of contacting emergency services, issuing safety instructions or performing a task where message loss could cause injury or serious harm.

Use on aircraft and in hospitals, vehicles, workplaces or other controlled environments is subject to the operator's rules and applicable law. Offline capability is not permission to use sound or a device where it is restricted. Do not operate the app while doing so would distract you from driving or another safety-critical activity.

7. Acceptable use

Do not use the service to harass, threaten, impersonate, defraud, unlawfully discriminate, infringe intellectual-property or privacy rights, distribute illegal content, or deliberately disturb others. Do not use repeated broadcasts or amplified playback to spam receivers or interfere with other communications.

Do not introduce malicious code, exploit the service to compromise other devices, or circumvent security controls unlawfully. This does not prohibit lawful security research, statutory interoperability rights, honest reviews or good-faith reports of defects. If you discover a security issue, contact us without disclosing other users' private information.

8. Advertising and third-party services

The app may display advertisements, including test advertisements in development versions. Ad availability and content can vary. An advertisement or external link is not an endorsement or a guarantee by Across Realities. Any purchase or other transaction with an advertiser is between you and that provider, subject to applicable law.

App stores, operating systems, advertising services, connected audio devices and linked websites have their own terms and privacy practices. Their conditions may apply to your use of those services. These terms do not make you responsible for obligations that applicable law places on Across Realities. See the Privacy Policy for advertising-related information processing.

9. Updates, availability and stopping use

We may release updates or change features for compatibility, security, maintenance or service development. We do not promise indefinite availability, support for every device or a fixed update schedule. Where a change materially affects existing use, we will provide appropriate notice where reasonably practicable and as required by law. We will not use a general change right to remove mandatory consumer remedies.

You may stop using the service at any time. Turn off reception and remove the app and its data if you no longer want local operation. Uninstalling does not retract prior broadcasts. There is no server messaging account that we can use to remotely erase nearby devices' conversation histories.

For serious misuse or legal and security reasons, we may restrict access to services we control where reasonably necessary and lawful. We do not claim an ability to remotely disable independent offline installations. Ending use does not extinguish rights or obligations that already arose, or provisions that by their nature continue to apply.

10. Warranties, responsibility and legal protections

Except for express commitments we make and rights that cannot lawfully be excluded, the service is supplied on an as-available basis without a promise of uninterrupted, error-free or universally compatible operation. It is not guaranteed to meet a particular communication range or complete a particular task.

Across Realities is not responsible for a failure or loss to the extent it is caused by environmental or hardware conditions outside our reasonable control, your unlawful use or disregard of reasonable playback precautions, or the independent actions of other broadcasters or recipients, rather than our breach of duty. Sound-related disturbance or harm is assessed on that same basis. This is not an exclusion of responsibility for our own conduct where the law holds us responsible.

To the extent applicable law permits, we are not liable for indirect losses that were not reasonably foreseeable from a breach, or business losses arising from use for a purpose we did not agree to support. We do not impose a blanket zero-liability rule, an arbitrary damages cap or an obligation to reimburse every claim against us.

Nothing in these terms excludes or limits liability for fraud, intentional misconduct, gross negligence where it cannot be excluded, death or personal injury caused by negligence where protected by law, or other liability that cannot legally be excluded. Mandatory rights concerning digital content, reasonable care, remedies, refunds or consumer protection remain in force. If a limitation is not permitted in your circumstances, it does not apply to that extent.

11. Questions, complaints and disputes

Please send service complaints or disputes to admin@across-realities.com with a description and relevant non-sensitive details so we can try to resolve them. Do not send passwords or unnecessary private conversations. Contacting us first is not a condition that prevents you from using a legal remedy or meeting a legal deadline.

Applicable law determines the governing law and courts with jurisdiction. These terms do not select an undisclosed foreign jurisdiction, require private arbitration, waive collective proceedings or deprive consumers of mandatory protections in their place of residence. You may use available consumer complaint or dispute-resolution procedures.

12. Changes to these terms

We may revise these terms for changes to the service, legal requirements or reasonably necessary operational matters. The date above identifies this version. Material changes will be communicated through an appropriate app or website notice, with advance notice and renewed agreement when required by law.

Changes are not intended to remove accrued rights or retroactively excuse a breach. If you do not agree to a change, you may stop using the service while retaining rights you already have. Continued use will not be treated as acceptance where applicable law requires a different consent process.

13. Interpretation and remaining provisions

If a provision is invalid or unenforceable, the remainder continues to apply to the extent lawful. A failure to enforce a provision immediately does not by itself waive it. Neither party may use these terms to remove the other party's mandatory legal rights.

The English and Korean versions are intended to have the same meaning; a translation difference does not override applicable law or mandatory consumer protections. The Privacy Policy describes information handling separately and does not replace these use conditions.
